For many Texas families, avoiding probate is the primary reason to create a revocable living trust. Assets held in the trust transfer to beneficiaries without going through Tarrant County probate court, which can save the estate time and reduce administrative costs. Because the trust is a private document, its terms aren’t filed in public court records the way a will is.

Incapacity planning is another important benefit. If you become unable to manage your affairs, the successor trustee you named can step in immediately without a court appointing a guardian or conservator. A trust also coordinates naturally with a pour-over will, powers of attorney, and beneficiary designations to form a complete estate plan. And because it’s revocable, you can amend or revoke it at any time as your circumstances change.

Revocable Trust, Irrevocable Trust, or Will: What’s the Difference?

A revocable living trust lets you retain control and modify the document freely, but because you’re still considered the legal owner of the assets, it doesn’t shield them from your creditors. An irrevocable trust removes assets from your taxable estate and can offer creditor protection, but you give up control and can’t easily change its terms once it’s established.

A will controls assets that remain in your name at death and must pass through probate. A revocable living trust controls only assets that have actually been transferred into it. Not every asset needs to be held in a trust. Retirement accounts, life insurance policies with named beneficiaries, and jointly owned property often pass to heirs through other means. Texas has no state income or estate tax, but federal estate tax considerations can influence whether a revocable or irrevocable structure better fits a larger estate.
